Every year, thousands of people are arrested for a wide variety of reasons. Many of those arrests are not for hideous crimes such as rape, murder and robbery. In fact, most of them are for mundane matters such as driving after having one too many. Being arrested can be very traumatic, however, but thankfully the justice system makes provision for accused to go free until their cases are heard. Every citizen has inalienable rights. One of those is to be presumed innocent until found guilty in a court of law. The justice system therefore makes provision for the release of arrested individuals until their cases appear in a court of law. Release is dependent upon a judge being convinced that the accused will not meddle in the case and will not pose a threat to anybody.

Release often entails paying a deposit to the court. This deposit must be cash money. The reason for this practice is that it is assumed that once a deposit has been paid the accused will not be tempted to abscond or to break the conditions of the release. The accused is kept in custody until the required amount is paid.

Many accused simply cannot raise the cash necessary for their release. This is when a bondman comes in handy. These lenders are willing to make loans to eligible accused and they will pay the deposit immediately. The accused will have to sign a contract and will be charged a hefty fee for the service rendered. In most cases the accused will be required to provide collateral such as the family home.

When arrested, the very first priority should be to get legal representation. It is most definitely better to leave the bail arrangements to the attorney. The attorney will help his client to retain his rights, including the right to remain silent. If a bondman is needed, the attorney will be better able to select a reputable person or company. The lawyer can also make sure that the agreement is fair.

It is only natural that the system has critics. These critics are of the opinion that release only leads to more crime. They forget, however, that every accused must be viewed as innocent until their cases have been heard. The justice system simply does not have the resources to keep every accused incarcerated until their cases can be heard. This process can take months.

There are other reasons why it is best to release people back into society after being arrested. Many cases are thrown out of court and keeping the accused in custody in such cases can lead to serious claims against the justice system. In many cases it is deemed to be best for society to allow the accused to continue providing a living for his family.

Being arrested can be a great shock. The first thing anybody in such a position should be to get legal representation. If let out on bail it is very important to keep to the conditions set out by the court. If this is not done, the accused can be arrested again and kept in custody for a long time. It is simply not worth the risk.
